Apple App Store Terms

If you access Idle Putter through the Apple App Store, the following additional terms apply and form the Apple-required licensed-application end user license agreement (EULA) addendum:

  • These Terms are between you and Thomas Martin, not with Apple Inc. ("Apple"). Thomas Martin alone is responsible for the App and its content.
  • The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions (except that the App may be accessed, acquired, and used by other accounts associated with the purchaser via Family Sharing or volume purchasing)
  • Apple has no obligation to provide any maintenance or support services with respect to the App. If any maintenance or support is required, Thomas Martin — not Apple — will be solely responsible
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App
  • Thomas Martin — not Apple — is responsible for addressing any user or third-party claims relating to the App or your possession and use of it, including: product-liability claims; any claim that the App fails to conform to any applicable legal or regulatory requirement; claims arising under consumer-protection, privacy, or similar legislation
  • In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Thomas Martin — not Apple — will be solely responsible for the investigation, defense, settlement, and discharge of that claim
  • You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties
  • You must comply with any applicable third-party terms of agreement when using the App (for example, your wireless data service agreement)
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary

Pursuant to Apple's requirements, the developer of the App is Thomas Martin. For any questions regarding the App, please contact us using the information in the "Contact" section of these Terms.
